Overview
These Terms and Conditions, relating to the website, web service and mobile applications belonging to Timenotes Sp.j. having its registered seat in Warsaw, entered into the register of entrepreneurs of the National Court Register with its registration no 0000719887, said website and location located at: timenotes.io (hereinafter referred to as the "Service"), lay down the terms and conditions of use of the Service.
1. Terms
By accessing this Service, you are agreeing to be bound by these Service Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site and the service.
2. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on Timenotes website. This is the grant of a license, not a transfer of title.
3. Disclaimer
The materials and content on Timenotes Service are provided "as is". Timenotes makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
4. Limitations
In no event shall Timenotes or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials and the service. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
5. Payments
Timenotes offers a free account plan, as long as User have registered to a free plan Timenotes is obligated to offer that service without any additional payments as long as you will not change your subscription plan yourself, even if such a plan will no longer be available to for the new users.
A valid credit card is required for you to continue using the Services on a Paid Plan, on a monthly/annual basis. Special offers may be granted to extend the plan usage for free period for selected users. The Services are billed in advance on a month or annual basis and is non-refundable. The billing cycle starts when you provide your credit card details and lasts a month or a year. There will be no refunds or credits for partial months, for deactivated users, or for months unused with an open account.
Services fees are calculated according to specified pricing on /pricing page of the timenotes.io website. All fees are not exempt of VAT imposed by EU and Polish Value Added Tax system. VAT shall be added if applicable for EU . We reserve the right to change service fees upon thirty, but such changes will be applicable only for the new users.
5a. Customer Reference and Marketing Use
By using the Service on a paid subscription plan, the User grants Timenotes a limited, non-exclusive, revocable right to use the User’s company name and logo solely for the purpose of identifying the User as a customer of the Service in Timenotes’ marketing and promotional materials, including but not limited to the Timenotes website, presentations, and marketing materials.
Such use shall be factual in nature and shall not imply any endorsement of the Service by the User.
The User may revoke this permission at any time by sending a written request to support@timenotes.io, upon which Timenotes shall cease such use within a reasonable time.
6. Links
We are not responsible for any third party websites that we link to.
7. Service
We reserve the right but do not have any obligation, to refuse service to anyone and close your account(s) without notice for any or no reason at all. We may suspend the Service for any reason whatsoever, including but not limited to, repairs, planned maintenance or upgrades, and will not be liable to you for any such suspension. We reserve the right to make any changes to the Service or to discontinue any aspect or feature of the Service without notice, and will not be liable to you for any such change.
8. Term of Service Modifications
Timenotes may revise these terms of use for the Service at any time without a notice. By using this Service you are agreeing to be bound by the then current version of these Terms of Service.
9. Governing Law
Any claim relating to Timenotes service shall be governed by the laws of state of Poland without regard to its conflict of law provisions.
